“An act against the constitution is void,” is a quote from James Otis, Jr. that represented the beginning of the American revolution.

In his arguments against the Writs of Assistance on Feb 24, 1761 – Otis rejected the notion that government held sovereignty, or final authority – and when government did something, it was up to government to determine if government violated the rules of the unwritten British Constitution. This was, as John Adams often put it, the “beginning of the controversy” between the Colonies and Great Britain, and represented a monumental shift in the understanding of sovereignty in American political thought.

At the end of the day, Otis set the foundation for the view that government couldn’t be the final arbiter of the extent of its own power – and that the Constitution was supreme – not the politicians entrusted with administering it.
